What are the mothers rights when she bears a child out of wedlock?

My daughter got pregnant with a child with her ex boyfriend in NC. When she was 3 months along she found out he was still married so she left him and moved in with us in SC. The baby is 9 months old now and she is using DSS to get support. The father has not seen the baby in 5 months and has not paid a dime to her for his support. Now that she is sueing for support he threatens to change the babys last name to his, steal her baby, force her to bring the baby to NC to visit him..blah, blah, blah. He is a trucker and made 161000. last year but has refused to work the past few months in order to not have to pay CS. Does my daughter have legal custody? Should she get a lawyer? The father is finally divorced and still living in NC.
